« Cette justice est très éloignée de celle des comparutions immédiates », souligne Tewfik Bouzenoune, avocat dans des dossiers d’atteinte à la probité. « La justice semble parfois considérer qu’une catégorie de personnes doit relever d’un certain traitement, qui les ménage : les modalités d’audition sont plus confortables, les personnes comparaissent libres et ont le temps de pleinement se préparer, avec un accès à une défense de qualité. » Les délais de détection, d’investigation et de jugement sont très longs.

Or, pour Benjamin Monnery, « les tribunaux sont toujours moins sévères quand la personne est jugée une décennie après les faits ». Ce point est d’ailleurs explicitement mentionné dans la décision de relèvement. Dans un récent rapport, la Cour des comptes notait elle aussi que « les atteintes à la probité se caractérisent par des délais de jugement exceptionnellement élevés » : 6,1 ans en moyenne, contre un an pour l’ensemble des contentieux.
