This is exactly right. The number of law review articles I see that fundamentally misunderstand historical research methods is startling. The problem only compounds when later articles cite that scholarship as historical authority.

In my historical methods training, I was always taught “we start with a historical question.” I would never use “I’m testing a hypothesis” in my work. I might have a working theory or a working hypothesis, but I’m certainly never *testing* it. That’s ripe for cherry-picked, law office history.

Codify Bivens. But even when victims sue, courts too often credit officers’ accounts of disputed facts & end cases before trial. True accountability requires more than just reforming qualified immunity. It also requires changing procedural practices that prevent juries from deciding what happened.

I have come to the view that law professors who wish to do historical research as part of their scholarship would, generally, benefit from formal methods training. That means taking classes with trained historians. At a minimum, they should adhere to the standards of the discipline laid out below.
