I agree. Beshear says the seat isn't technically vacant, and he doesn't have to power to declare it vacant. I think he might have that power, but it's not been litigated. I think what will happen is if Thune declares it vacant, or Mitch dies, Beshear will appoint a dem and fight the fight. We'll see
