~2 decades ago, then Maricopa sheriff Joe Arpaio accused his opponent of sexually abusing their own stepmother as a teenager. Local news ran with it. Instead, it was the other way around & the stepmother had abused her other kids too. Arpaio even tried to get the Pima sheriff to charge his opponent.

Tomorrow is a closed hearing in the case for Tyler Robinson and Judge Tony Graf has ruled that the livestream will NOT be broadcasted. Reading the court docs now and Robinson’s attorneys are asking for the trial to begin around summer 2029, while prosecutors want the trial to begin in January 2028.

PROPOSED ORDERS Mr. Robinson respectfully suggests that the Court proceed as follows: 1) Direct the parties to meet and confer and thereafter propose to the Court in writing cut-off dates for the filing of the "immediate motions" ("Phase I") and "discovery related motions" ("Phase II") that Mr. Robinson presently anticipates filing during the balance of 2026 and during the first quarter of 2027, and during the second quarter of 2027, respectively, after which the Court would set dates for the hearings on those motions, some of which are anticipated to require an evidentiary hearing and would therefore need to be coordinated with the availability of lay and expert witnesses. Footnote: Canon 2.9(A)(4) provides, in pertinent part: "(A) A judge shall not initiate, permit, or consider ex parte communications, or consider other communications made to the judge outside the presence of the parties or their lawyers, concerning a pending or impending matter, except as follows: (4) A judge may, with the consent of the parties, confer separately with the parties and their lawyers in an effort to settle matters pending before the judge." 2) Tentatively target the beginning of a six-to-seven-month trial during the third quarter of 2029. 3) Direct the parties to each file discovery status reports at the beginning of each quarter, with the first report being due in mid-January 2027. 4) Schedule quarterly hearings in 2027 and 2028 that are specifically devoted to assessment of the continuing viability of beginning trial during the third quarter of 2029.Proposed dates: ба. Trial commencement date. The State believes that it could be prepared to begin trial on October 4, 2027. But given the 17-week anticipated length of this trial, the State does not believe that it is wise to schedule the trial to span the worst of the winter season and the Thanksgiving and Christmas holidays. The State therefore proposes that the Court schedule the trial to begin January 31, 2028. A trial that would run from early October 2027 through the end of January 2028 would place significant additional hardship on the jurors and therefore further complicate an already complicated capital voir dire process. The schedule would also require the Court to seat additional alternate jurors because holding trial during that season would surely increase the risk that (1) jurors would get sick, and (2) some jurors would not follow the Court's admonitions to refrain from talking about the case. This is especially true when most—if not all—of the jurors will likely gather with extended family and friends over the holidays. The Court would also have to schedule holiday breaks which will significantly interrupt and extend the trial. Those interruptions could impair jurors' ability to track the evidence because the breaks will necessarily interrupt the continuity of the parties' presentations. A trial through the winter and holidays will also be more diffi cult for both the State's and Defendant's witnesses to accommodate. The Court could avoid these difficulties by scheduling trial to begin January 31, 2028, as outlined in the State's Proposed Scheduling Order. (Ex. A).
