After failing to secure an indictment on Oct. 9, transcripts show a grand juror asked prosecutors the next week if they had “unlimited tries” to bring the case for indictment by the grand jury. One replied, “I think the saying is the second time is the charm.” It wasn’t. In fact, things got worse:
