D. The Court should require the government to produce all of the Clearview AI reports it generated of protesters and activists during Operation Metro Surge. HSI employed Clearview AI as an investigative tool in this case. See, e.g., Ex. 30. The government has produced only two Clearview AI search results related to Project Whipple Shield and Operation Puppet Master. The report generated for Mr. Sant includes results “accepted” as matches to Mr. Sant that are clearly not him. For example, Page 8 of the Clearview AI results for Mr. Sant contain photos of another man and his family, including the man’s pregnant wife and young daughter, pulled from that man’s Facebook page and now inextricably linked with Mr. Sant in HSI’s internal databases. Remember, it's virtually impossible to sue federal agents, so it will be basically impossible to hold ICE officers who shock people without justification accountable. We should not be giving new weapons like this to a law enforcement agency that enjoys near-total impunity.

I once conceived a plot for a very dark, dystopian fiction that I told one person about and have never worked on. I put it away because people like Nancy Mace would use quotes from it to completely ignore the point of the text. Also, #AltText for that:

S.1404 establishes a centralized system of state surveillance with an ICE appointee as director. There is no reason to think that ICE would not abuse such a system were they to have access to it, given their documented history.

Excerpt from S.1404: “(1) ESTABLISHMENT.—Not later than 90 days after the date of enactment of the Combating Organized Retail Crime Act, the Secretary shall direct the Executive Associate Director to establish the Organized Retail and Supply Chain Crime Coordination Center. “(2) DUTIES.—The duties of the Center shall include— “(A) coordinating Federal law enforcement activities related to organized retail and supply chain crime, including investigations of national and transnational criminal organizations that are engaged in organized retail and supply chain crime; “(B) establishing relationships with State and local law enforcement agencies and organizations, including organized retail crime associations and cargo theft associations, and sharing information regarding organized retail and supply chain crime threats with such agencies and organizations; “(C) assisting State and local law enforcement agencies with State and local investigations of organized retail and supply chain crime groups; “(D) establishing relationships with retail, transportation, and other companies determined by the Executive Associate Director to have significant interests relating to organized retail and supply chain crime threats, sharing information with those companies regarding such threats, collaborating on investigations and loss prevention activities as appropriate, and providing a mechanism for the receipt of investigative information on such threats; “(E) establishing a secure system for sharing information regarding organized retail and supply chain crime threats by leveraging existing information systems at the Department of Homeland Security and the Department of Justice; “(F) tracking trends with respect to organized retail and supply chain crime and releasing annual public reports on such trends; and “(G) supporting the provision of training and technical assistance in accordance with subsection (c).
