The way I look at American political structure: the system is built for two parties. If you aren't in one of the parties, you're essentially irrelevant. So the only practical move is to make one of them work more like you want it to. The Tea Party et al did this and then some with the Republicans.

Calling an assurance that someone who isn't involved in the negotiations will follow the law isn't anything to be proud of. It codifies that whether or not the law needs to be followed is up for negotiation. This is terrifying precedent of the Dems' making.
