The ICJ today rejected Sudan's case against UAE for complicity in genocide because of a UAE-reservation to the Court's jurisdiction under the Genocide Convention. Interestingly, the vote was 14-2 on rejecting provisional measures but much closer (9-7) on removing the case from the General List.🧵

A new genocide-case has been filed at the ICJ: Sudan has filed an application on alleged violations of the Genocide convention by the United Arab Emirates in relation to support provided to the Rapid Support Forces: www.icj-cij.org/sites/defaul...

The ICJ will deliver its provisional measures order in Sudan v. UAE on Monday (5 May 2025). The Court will probably say that the UAE's reservation to article 9 of the Genocide Convention deprives the Court of jurisdiction. But you never know.

'Inconsistent' as in incompatible / flatly contradict / manifestly violate Article 5, given that it expressly provides that an attack on one (or more) members shall be considered an attack against them all. In other words, Article 5 entails a binding commitment to collective self-defence.

Such a policy would be inconsistent with Article 5 of the North Atlantic Treaty and the President’s constitutional duty to “take Care that the Laws be faithfully executed”, as the “Laws” include treaties.
