Today, Max Miller demonstrated one of many reasons why, when you’re confronted with charges of criminal behavior, the best thing to do is almost always, “STFU!” This is especially true for DV & SA allegations. Get a lawyer. Let them speak for you when, where, and how it’s appropriate.

A couple years ago, all four of the conservative Republican members of the Ohio Supreme Court joined an opinion that respectfully used she/her pronouns to refer to a trans woman in the case. Acton should be able to show at least that much respect for trans people.

My mom passed away early this morning. The photo is from when she got her MSW at the same time I got my high school diploma. I suspect she’s a big part of why I ended up as a public defender.

My general rule of legal commentary—if a person who faces real consequences for a wrong legal decision has a competent lawyer, that competent lawyer is more likely to be right about how the law applies to that person than anyone looking in from the outside, even smart people with real expertise.

The professor’s *general* Fifth Amendment analysis is almost certainly correct, but applied to this very specific situation, which includes a pardon for past statements, I’ll give Fauci’s lawyers some deference that they’ve gone through the analysis and weighed the risk of perjury & contempt.

It certainly sounds like Fauci is saying that he thinks Paul is trying to trick him into perjuring himself. But that can't justify invoking the Fifth Amendment, otherwise anyone could get out of testifying anytime by claiming that, if they testified, they might lie. That can't be right.

Given the alternative, I’ll almost certainly hold my nose and vote for Acton, but it’s sad that Ohio has a lesser-of-two-evils race for governor.

Recusal should be hard and rare. People should remember that an overly broad recusal system can be gamed to kick judges we like off cases, too. And it’s easier for a majority party to game a recusal system to effectively eliminate minority party judges than the other way around.

Recusal seems appropriate here (if the majority’s facts are accurate), but I disagree that recusal should be more frequent. Recusal doesn’t end the appearance of unfairness, it just extends it to include the gaming of the recusal & replacement process. Recusal should be extraordinary, not ordinary.

One of the fun parts of my job as an appellate lawyer is traveling to beautiful and historic courthouses across Ohio, usually to make sure the appellate record is complete. Today, Morrow County. Also, I had lunch in a local cafe/lunch place, and it’s a comfortable 74°, so a beautiful day all around.

The most depressing part of the law prof discussions of exam procedure—the apparent rampant cheating when using AI is prohibited but law students think they can get away with using it. Maybe AI-use should always be allowed, but that’s not my point. If the rules of a test ban AI, using AI is cheating

The conversation goes something like this: “Time shouldn’t be a factor. Just give long take-home exams!” “But long take-home exams allow AI and cheating. We need in-person exams.” And round and round we go. (With an occasional “Don’t you trust your students not to use AI?” … “No.”)

The *vehicle* did not drive into the crowd of people. The *killer* drove the vehicle into the crowd of people. This is one of the worst times to use the automotive exonerative.

As a side note, “Make a legal thing so I don’t have to do that” is such a brilliant way to describe how a smart, literal, plain-speaking client might talk to their (its) lawyer.

I gave up and just instituted a rule that people were allowed to say “oh my god” in a pantheistic society because “oh my gods” just hits my ear wrong.
