The Board of The Kennedy Center today agreed, almost unanimously, to close the Building for Safety reasons, and so that it can begin the process of Reconstruction. The closing will take place immediately, however, the Renovation and Reconstruction, which is a very large and complex job, cannot begin until such time as the D.C. Circuit rules on the Board’s approved name. If the ruling is a negative one, which it should not be, and is not overturned by the U.S. Supreme Court, the Reconstruction and the Renovation of The Kennedy Center will not take place. The attorneys from the DOJ will ask for an expedited appeal. In the meantime, 17 Million Dollars, raised by President Trump, has been put into The Kennedy Center account to keep it afloat. No matter what you think about ICE, this is sad. ICE shouldn’t have hired him in the first place (he seems to have had big impulse control issues) and wouldn’t have if they had done background checks *before* giving him a badge and a gun. Now a man is dead, and the Trump admin bears responsibility.

ICE notified Moore in late August that he was going to be fired and instructed him to come to the agency's Philadelphia office, according to two federal officials who also spoke on the condition of anonymity to discuss personnel matters. ICE had identified issues in his past, the officials said, including being fired from other law enforcement agencies. The 38-year-old father of two had fought for his job when supervisors wanted to fire him in the past. This time, he parked his car in a lot outside the office, and he had his gun. Law enforcement officers tried to stop him, but Moore eventually shot and killed himself, according to the Philadelphia Police Department.

My read is that there aren’t five votes to let Trump literally rig elections. Roberts and Barrett won’t greenlight overt election subversion or chaotic, illegal interference with voting. Kavanaugh and Gorsuch aren’t reliable but don’t love the chaos either. Thomas and Alito want to end democracy.

Second, the plaintiff States and the courts bear a substantial share of the blame for the rule’s timing. In April, the plaintiff States sued to challenge the President’s internal directive to subordinates mandating a rulemaking. For months, this litigation cast a cloud over the Government’s ability to issue a final rule. The District Court entered several injunctions months later prohibiting the Government from undertaking that rulemaking. Not only was the Government subject to months of premature litigation and a series of injunctions that this Court later determined were likely issued without jurisdiction, the Government had to wait nearly another full month for this Court to issue its decision so holding. Indeed, this Court spent from late July to the end of August drafting nearly 40 pages of opinions, including two dissents, despite the Government’s public notice that it would not publish a final rule while subject to the injunctions, see 91 Fed. Reg. 44880, and its representation that it had a strong interest in issuing its rule in early- to mid-August to allow time to implement it. The plaintiff States cannot claim the timing of the rule tilts the equities
