Thank you, NAACA, for having me this year! I ❤️ talking about the intersection of legal ethics and tech with the amazing lawyers on the frontlines in our courts!
Not enough discussion of the performative cruelty of the bar exam mentions its racist and classist history, and it's always good to see an article that does!
I wrote about the hotass mess that hundreds of recent law grads in Washington are going through for no good reason! ballsandstrikes.org/legal-cultur...
Thank you, @joepatrice.bsky.social for your consistent critique of the NCBE. Sometimes it feels like only @aaselaw.bsky.social and @abovethelaw.com are asking state supreme courts to hold this monopoly accountable. BAR TAKERS DESERVE BETTER THAN THIS MESS. abovethelaw.com/2026/07/the-...

Hearing the roll out of the NCBE's new NextGen bar exam isn't going so well today. This is horrible for the bar takers who have spent time and money preparing for this high-stakes exam. If only there was OVERSIGHT or ACCOUNTABILITY of the NCBE!!!
The NCBE is an unchecked gatekeeper with a monopoly on the bar exam. The legal profession should be ashamed to support it. Good luck, bar takers! Pass the bar, then abolish it. 🔥
Reminder to everyone taking the bar: regardless of what happens, you will have sat for one (1) more bar exam than Judy Gundersen, the president of the National Conference of Bar Examiners 🥳
Why do I doubt the FL Bar will actually file disciplinary charges, though?
BREAKING: A federal judge just nullified Trump’s $1.776 billion IRS “settlement,” ruling it had “no viable basis in law or fact,” finding there was never a real legal dispute, and referring Trump’s attorney to The Florida Bar for possible discipline.
This. Enough of the gaslighting. AI isn't great, and I will not pretend that it is just to prop up the oligarchs.
Got alt text for you.
National Conference of Bar Examiners (NCBE) a non-profit and maker of the UBE and NextGen UBE posted $65 million in revenue. Key employees make over $200k and $400k. FY ending June 2025. Form 990. The more you know, the more you want to abolish the bar exam. projects.propublica.org/nonprofits/o...

Sure. But first state Supreme courts need to abolish the bar exam run by the NCBE, which is a far bigger antitrust issue for aspiring lawyers in this country.
“We propose that state supreme courts amend their rules of professional conduct to impose a uniform ‘hold open’ date for offers until Oct. 1 of students’ 2L year for 2L summer positions.” @marklemley.bsky.social & I have an op-ed in Bloomberg on early recruiting news.bloomberglaw.com/us-law-week/...
It’s incredible to think this was written over sixty years ago. Eerily prescient.
Just out walking my Frank n' Weens. (Lil' Frank, Mycroft and Daisy Buchanan)
Guess what? We are NOT ready. Why we continue to let the raggedy tail of the NCBE wag the dog of lawyer licensure is a scandal. www.abajournal.com/web/article/...
The NextGen UBE launches next month; are we ready?

The Knicks burned up the court last night, and today I am lighting a fire for change in lawyer licensure in PA. 🔥
This is AMAZING.

GOOD!!!!! Come on, states. This is your time to shine. Dust off the dormant commerce clause and get to work creating guardrails for AI technology.
Sorry for the delayed update, but the bill has passed! 🎉🎉🎉 It will go into effect in August. this really is the first law in the US explicitly prohibiting the technology/service of AI nudification/deepfake pornography. Would love to see this as a model nationwide www.cbsnews.com/minnesota/ne...
