I have been wondering about this for a slightly different reason which is that a lot has changed on the ground since 2024 including the SCOTUS ruling on trans sports and rule changes by sports orgs. These developments somewhat defang Republican talking points on that issue.

Major u-turn from Justice Alito as Supreme Court reveals he will no longer participate in the big climate change case being argued next week. Previously, the court told NBC News there was no reason for him to step aside despite his earlier recusal in same case.

It's a day that ends in 'y' so there's a new Trump emergency application filed at the Supreme Court, this time seeking to enforce the administration's policy that restricts gender-affirming care for transgender inmates.

"a brazen escalation by the Solicitor General" is what @stevevladeck.bsky.social calls the SG asking court to refer his request for an administrative stay to the full court if Jackson (as the circuit justice) declined to issue one.

I’d missed SG Sauer’s sly attempt to impugn Justices Jackson in his DHS v D.V.D petition. Thanks for lifting that up @stevevladeck.bsky.social . open.substack.com/pub/stevevla...

It's the Supreme Court's 'long conference' today when the justices meet in private to discuss which of the appeals that piled up over the summer break they should hear. Four votes needed to do so. Expect news on that later in the week when a list of cases is usually released.

The more I think about punishment the more I think retroactivity is not the way to go. Nothing can change what happened. An asterisk can suffice. Instead, I would go for a massive financial penalty, transfer ban, European ban and a 75 point deduction spread over 3 seasons (ie 25 each season).

Trump complains about the Supreme Court over its refusal to meddle in Missouri election law on 3 occasions. He is also factually wrong as it was only 2 times that the court blocked lower court judges. In the other it refused to block a ruling by the Missouri Supreme Court interpreting state law.
