Pretty outrageous that the Supreme Court increasingly plans to release its records only when the entire public that lived through the decisions are dead. Congress should pass legislation requiring all internal communication be preserved and then released 5 years after a justice's retirement.

/2 Second: federal judges don’t talk like this unless it’s REALLY bad, and it is.

72 years ago today, the Supreme Court decided Brown v Board Education which the Court really never enforced. The Civil Rights Act of 1964 and lower court judges did most of the work. The Roberts Court in Parents Involved and SFFA v Harvard shattered its promise and lied about what it actually said.

There’s not a shred of legal analysis in the Standards Committee’s memorandum: the rationale is simply “Trump’s Education Department will come after us if we don’t capitulate.” If the ABA is unwilling to stand up for multiracial democracy, the ABA shouldn’t exist.
