When opposing counsel tries to hide that he is using AI to write his briefs by doing a global search and replace for em-dashes and replacing them with commas. But that means all of his writing is littered with things like this , where the comma has a space before it , and he thinks we don’t notice.

I keep on getting the craziest trademark cases. Law school students would never believe that the hypotheticals they face on exams are nowhere close to as crazy as what you come across in real life.

Legal folks, does anyone have any recommended training or notes on doing live cross-examination of a witness that you are hearing testimony for the first time? I've had two TRO hearings this year where I was opposing, and I had to cross a witness who gave long testimony.

Cash bail should be banned. Someone's ability to be released from jail should not depend on their resources. It should be based upon their continued threat to society and what mitigation efforts the state can use to manage that threat.

The "tough on crime" types want us to think that cashless bail means ppl charged with murder walk. Two things: 1. Even in the most liberal of places, like NYS, they don't. 2. Don't forget: charged does NOT mean GUILTY. We make mistakes--and those wrongly detained get NOTHING.

I am generally very critical of BigLaw because I think they are usually overpriced and not worth the money. However, I have had the pleasure of using WilmerHale's IP group in litigation matters, and I cannot overstate how much they impressed me. Are they cheap? No. Are they worth it? Absolutely.

This is how it's done. A strong and principled response by WilmerHale to the illegal Executive Order attack - a form of attempted government intimidation declared unconstitutional by a federal judge. This is how to guard the rule of law.

So Trump and Musk are just mindfully dismantling everything as a vendetta for what they deem a problem or "crime" against them. Nothing is really about making America a better place, it's all just a "get back" scheme for their hurt feelings.

Dumb question for patent friends on here: What is the best format you have seen someone put out claim charts in? I have done claim charts in Word, XLS, and PPT, and I have always waffled about what format looks best. This is for internal viewing, not production to Court.
