Ugh. Supreme Court rules in Slaughter, 6-3 that Trump can fire people from the FTC. But in Cook, Court rules 5-4 that Trump cannot fire everybody from the Fed. Roberts writes both majority opinions There's no real difference between the FTC and the FED other than Roberts likes the Fed.

“for no reason other than its own policy preference.” This is key. The Republican majority here is making policy, not deciding the law. The “umpire” is swinging the bat and running the bases.

The Cook and Slaughter opinions, released together, show just how political the Supreme Court is. As Kavanaugh's concurrence in Cook makes clear, the Court treats the Federal Reserve as special for no reason other than its own policy preference.

There's no sugar-coating Slaughter. It's an enormously important ruling (far more important than the other three decisions #SCOTUS handed down today). It's a huge win for Trump/the executive. And it's going to have massive ramifications for the functioning of the government long after Trump is gone.

This is so important. Thanks @fishkin.bsky.social for underscoring this false distinction that allows partisanship to serve as a mask for racial gerrymandering that will undercut Black representation.

All the partisan gerrymandering was always (in part) racial gerrymandering, because the parties' politics were always (in part—but large part) about race. So when you tell Southern legislatures "you can do partisan gerrymandering, but no racial gerrymandering," they know it means they can do both.

By all that is holy, if and when SCOTUS decides that birthright citizenship is protected in the Constitution, don't let the 3-3-3 numpties tell you this is a moderate, centrist court. Rejecting an a-textual stupid Hail Mary doesn't cash out to a push when it comes to eviscerating the VRA today.
