Today, the #HouseofLords published its awaited report examining the state and quality of the #RuleOfLaw in the UK. The report highlights with concern the weakening of this foundational value, and calls on Government and politicians to take stronger action to defend it.

A new Explainer out from @aoifemod.bsky.social and me detailing the UK's ECHR commitments under the 1998 Agreement in response to recent speculation. It is short, because there is very little to say - the UK's obligations are evident on the B/GFA's plain text: caj.org.uk/wp-content/u...

"Does taking the UK out of the ECHR breach the Belfast/Good Friday Agreement?" Yes. "But what if..." No. It breaches the Agreement. "Ok, but..." No. Unless your position is "renegotiate with Ireland and conclude a new Agreement including NI parties", it is a breach.

Following ECHR debate, imagine if "reform is hard, so just remove it without replacing it with anything else" was policy applied to other foundational parts of the state, governance and law - like the NHS, the police or education?

"Does the ECHR stop states from controlling their borders?" No. The ECHR Court emphasises migration policies are up to states themselves. "But the ECHR stops the UK from deporting foreign criminals." No, it doesn't. Successful human rights-based appeals against deportation are very rare.
