Just because SCOTUS affirms a type of discrimination does not mean that discrimination is required. This decision should not cause us to weaken our efforts for trans inclusion in general or trans inclusion in sports in particular. Cis allies, you very specifically, need to double down.

The point is pretty simple. Despite escalating attacks, the reality is that support for and acceptance of transgender people is widespread—and that transgender people can and do live joyful, fulfilling lives, given the chance. But instead, politicians are making a game out of trans people's lives.

And while these data points were already published, they are so important to keep elevating: when transgender people are able to access the medical care they need, their life satisfaction dramatically improves.

Trans people in faith communities also reported widespread experiences of support. This is especially notable given the frequent and false pitting of faith and transgender rights against each other. Trans people are also people of faith, and many people of faith support trans people and rights.

Policy lags sentiment, so I still don't think we've seen the worst - I thing things will continue to get worse for trans people in both red and blue states for a little longer before it gets better. But I do think the anti-trans wave has crested.

Can't recommend this analysis of Chiles enough--and from someone who's been working on this issue from the very beginning. "Practically speaking, ...we didn’t lose much today. We just outgrew one of our tools. It still gets to feel like a gut punch in a year of gut punches."

It's still just under the wire of TDOV on the East Coast - but SCOTUS made sure this wasn't like any other TDOV. I thought some perspective on Chiles v. Salazar from someone who spent their spryest years in the fight to end conversion therapy might be useful. sames.substack.com/p/the-suprem...

Today's Ruling: ❌ Does not legalize conversion therapy ❌  Does not immunize practitioners from civil liability ❌ Does not alter the overwhelming medical and scientific consensus  that conversion therapy is dangerous, ineffective, and harmful

The ruling is narrow. Survivors still have legal options to fight back against the harms of conversion therapy, including medical malpractice, consumer fraud claims, and intentional infliction of emotional distress.

There will be a lot of commentary about the Chiles decision. I strongly encourage folks to listen to the movement lawyers at the heart of this case, eg @nclrights.bsky.social, and how they interpret the decision. Yes, this is a loss, but one of the best things you can do to help right now is

Judge asks a great Q. Lot of states don't have sex designations but instead rely on trespassing or assault charges, the conduct of alleged perp rather than just sex-status.
