Almost any fine against the gov't is going to be perfunctory, but it is coercive for executive branch officers and attorneys, at least short of anyone cabinet-level and above. The award of attorneys fees is significant as this drags on. The longer DHS drags this out the harder it is to go on.

Fed. judge holds DHS in civil contempt of court for refusing "intentionally and not in good faith" to provide plaintiffs with phone images they intend to use to prove DHS was racially profiling people arrested in Los Angeles without reasonable suspicion. Order from July 28, unsealed today.

B. Defendants’ Noncompliance Is Intentional And Not In Good Faith. Having found that Defendants are in violation of the January 16 Forensic Imaging Order, the burden now shifts to Defendants to show that they were unable to comply. Affordable Media, 179 F.3d at 1239 (9th Cir. 1999). They fail to make that showing. Upon review of the parties’ submissions and counsel’s representations at the hearing, it does not appear that Defendants’ noncompliance is due to an inability to comply. Instead, the clear and convincing evidence shows that Defendants have acted intentionally and not in good faith.

An inset circle shows two burrowing owls, highlighting wildlife concerns. Large white text over the image reads, "NEWS: DATA CENTER GROWTH RAISES NEW CONCERNS FOR WILDLIFE," with a small bird logo in the bottom-right corner.

The fact that the Democratic senators are agreeing to a continuing resolution until Dec 11th with NO compromises for them is absolute political malpractice and head scratching. Why not even try to ban like…. The arch? Anything!

New Mexico's attorney general has sued the Trump Justice Department over its refusal to share unredacted documents from its files on Jeffrey Epstein — arguing that the Trump admin is obstructing the state's criminal investigation of Epstein.

The Dem tent is big, BUT, there is no room for anyone who isn't in favor of universal healthcare. This is a HUGE rural issue that would be a game changer. Any Dem candidate who wants some hybrid version like what we had with Obamacare, must be deep in corporate pockets -and that will no longer fly
