In Lackey v. Stinnie, #SCOTUS made it harder for civil rights plaintiffs to recover fees as prevailing parties. But Congress can and should change underlying law, argues Cato's Thomas Berry, to designate a party "prevailing" if it wins a preliminary injunction before a case becomes moot.

They dont have arrest authority, so "resisting arrest" is not in fact the justification they think it is. Nor do they have jurisdiction over criminal law (like assault). The problem is they do have an extremely low burden of proof on immigration stops (reasonable suspicion).

Another ICE "assault" case unravels. Border Patrol and ICE are arresting US citizens and then after they find out that they are US citizens, they are charging them with "assault" to justify their actions. This is clearly DHS policy at this point. We've seen it repeatedly now.
