State's Attorney Burke City Club Speech Disrupted By Protesters Today, Cook County State’s Attorney Eilieen O’Neill Burke spoke at a luncheon hosted by City Club to celebrate her first year in office. The speaking engagement was repeatedly disrupted by community members who were dismayed with the direction Burke has taken the office in. Statement from Protesters: “In the year since State’s Attorney Burke took office, the number of people caged in Cook County Jail has gone up by nearly 15%. This would be disturbing at any time but is truly shocking at this moment when our county has seen some of the biggest decreases in crime in decades. We have seen the impact mass incarceration has had on our neighborhoods and we are not safer for it. Our communities worked tirelessly to rollback some of the worst impacts of the Cook County State’s Attorney Office and now Burke is returning to the corrupt and racist policies that made Chicago internationally known for its corruption. We are not safe when people are locked up while awaiting trial, costing them employment, and housing. We are not safer when thousands of innocent men and women are fighting for post convictions to gain their justice and freedom after decades of being wrongfully convicted and imprisoned. We need to invest in our communities, not incarcerate them. We are sounding the alarm, Cook County State’s Attorney Eileen O’Neil Burke must go!”

The Law Office of the Cook County Public Defender has opposed the State’s Attorney’s felony bypass policy since its inception, and we oppose any expansion. This policy abandons prosectors’ duty to review felony charges and simply hands that responsibilities over to police, who have an obvious incentive to bring charges in cases whether there is evidence to support them or not. While the State’s Attorney’s Office claims this policy will free prosecutors to focus on more serious cases, the more likely outcome will be thousands of nonviolent gun possession cases that shouldn’t be filed clogging up the courts, 30% of which end up getting thrown out. Chicago police have a long history of misconduct connected with the types of traffic stops that usually initiate these nonviolent possession charges, including racial profiling and conducting unconstitutional searches. A CBS news report last month highlighted the Chicago Police Department charging Black gun owners with unlawfully possessing a firearm even when they were legally allowed to. We would think this would necessitate reexamination of the felony review bypass policy—not expansion. Coupled with the State’s Attorney’s Office’s other harmful policies, including seeking detention in almost all gun cases without considering the facts unique to each person, bypassing felony review runs a significant risk of unnecessarily involving people in the criminal legal system. Even someone who is later proven innocent or whose case is dismissed is harmed by the arrest and filing of felony charges without proper prosecutorial oversight. Arrests, possible pretrial detention, and the burden of having to appear in court all lead to a higher likelihood of rearrest in the future and jeopardize the real building blocks of safe communities: stable employment and housing, continuous access to mental and physical healthcare, and strong family relationships. We urge the State's Attorney’s Office to end this policy and take an active role in reviewing the quality of all gun possession cases before charges are filed.

CCSAO INTRODUCES NEW EXPEDITED FELONY REVIEW STANDARD Certain nonviolent felony gun charges will now be filed directly by trained CPD officers, freeing up police and prosecutorial resources to focus on violent crime and victim support. CHICAGO — Cook County State’s Attorney Eileen O’Neill Burke today announced the citywide implementation of Expedited Felony Review (EFR), an expansion of a successful pilot program that allows comprehensively trained Chicago Police Department officers to directly file certain nonviolent felony gun possession offenses. The EFR was developed in collaboration with CPD and is designed to address a longstanding bottleneck and drive efficiencies in CCSAO’s felony review process, allowing prosecutors to focus on violent and victim-centric crimes, while also freeing up police officers to get back on the beat more quickly after making a gun possession arrest. “The goal of this initiative is straightforward: to get police officers back on their beats, not tied down at their desk waiting on a phone call,” State’s Attorney Burke said. “It also allows our office to dedicate prosecutorial time and attention to more complex cases, where evidence needs to be reviewed in person and victims and witnesses need to be spoken to as quickly as possible. Expedited Felony Review is a new standard for law enforcement collaboration, smart resource allocation, and public safety.”
