As Americans confront the rapid growth of AI data centers, Alliance governors are stepping up to protect ratepayers, communities & the environment.  From New York to Oregon — & beyond — governors are working to establish strong guardrails & tackle data centers’ growing impacts.

New York Governor Kathy Hochul signed an executive order placing a one-year moratorium on all data centers larger than 50 megawatts while the state works to develop new regulations. The state is also creating a Community Investment Framework to help communities benefit from data centers post-moratorium.New Jersey Governor Mikie Sherrill just signed legislation creating a new ratepayer class for data centers that will ensure they pay for their own energy use and associated grid infrastructure. Sherrill also released a comprehensive framework for data center investment in New Jersey that includes the development of strong statewide standards for Community Benefits Agreements. Arizona Governor Katie Hobbs signed into law a three-year pause on new data center tax breaks, instead investing the $57 million estimated revenue into childcare, rural hospitals, and food assistance in the state’s new 2026 budget.Through its POWER Act, signed into law last year by Governor Tina Kotek, the Oregon Public Utilities Commission recently approved a rate hike for large energy users, including data centers. The POWER Act created a new rate class for these large users and required them to pay for their share of electricity usage.
