NEW: After Judge Chutkan issued an order today requiring 30-minute notice of any on-site or off-site activity in preparation for the building of Trump's arch, DOJ filed a notice tonight that Grunley Construction Co. has applied for a permit to do arch-related work. Approval will take a few steps.

It is FURTHER ORDERED that Defendants shall file a notice on the docket within
thirty minutes of any activity related to or in preparation for the construction of an arch on Memorial Circle. Such activity includes, whether on-site or off-site, directing personnel, contractors, or equipment to Memorial Circle, closing lanes or roads, and any physical work on Memorial Circle. It does not include internal planning or the preparation of compliance documents.
The notice requirement in the preceding paragraph does not apply to (1) emergency response; (2) routine park maintenance unrelated to the arch; or (3) on-site information gathering regarding archaeological resources that may be present at the site.NOTICE
Pursuant to the Court's Order, Dkt. 101, Defendants submit this notice regarding an application from Grunley Construction Company, Inc., for a special-use permit from National
Park Service (NPS) authorizing construction mobilization for an arch on Memorial Circle. The
application requests authorization to perform the construction mobilization steps outlined in
Nersesian Declaration 49 8-11, Dkt. 95-9. Although NPS has not yet issued the permit (which
is prerequisite for Grunley to begin work on and around Memorial Circle), Grunley may be—
but is not necessarily-arranging off-site preparations for construction mobilization in
anticipation of permit approval. Again, NPS has not yet approved the application and does not
