In my view, based on the briefing the Court has received at this interim stage, there is at least a fair prospect that the final rule falls within the Postal Service's statutory authority. See 39 U. S. C. §401(2). But applying the rule in the 2026 elections would be arbitrary and capricious in violation of the Administrative Procedure Act because state and local election officials do not have sufficient time to reasonably implement the rule before the elections. See 39 U. S. C. §3001(m); 5 U. S. C. §706(2)(A). For that reason, I concur in the denial of the application for stay.

The increase in the price of diesel is not mostly caused by Ukraine's defense against Russia's genocidal re-invasion of Ukraine. Even if it was, there is a simple way for the US to resolve that: make it very clear to Putin to withdraw or face real consequences from the US & its allies & partners. 1/

This female Pileated Woodpecker was hammering away on a tree when a Sharp-shinned Hawk landed nearby, followed by the hawk being promptly dive-bombed by Blue Jays. After the hawk left, the Pileated decided to head out for a different, and probably quieter, tree.

Together, the USPS decision and the Missouri decisions mean that SCOTUS - while radically restructuring government in lots of ways - is effectively done with last-minute changes to the election process. At this point, the rules are what the rules are. It’s just going to be up to the voters.
