that Plaintiffs' Motion for a Stay of Agency Action under 5 U.S.C. § 705, ECF 22, is GRANTED.
It is further ORDERED that, to preserve status or rights pending conclusion of the review
proceedings, the effective dates of implementation and enforcement of the January 23 Huffman
Memorandum, February 18 ICE Directive, and March 25 Parole Termination Notice for Cubans,
Haitians, Nicaraguans, and Venezuelans (CHNV) are immediately postponed and stayed insofar as they subject individuals who have previously been granted parole at ports of entry to expedited removal.

"SCOTUS did not address the constitutionality of the birthright citizenship executive order, which every court has found to be flagrantly unconstitutional. Instead, the Supreme Court used this case to limit the use of nationwide injunctions, a legal dispute that has been brewing for years. As a consequence, the Supreme Court has sent a shock wave to immigrant communities across the country and failed to take into account the grave human consequences at stake."

"SCOTUS’s order does not take effect today. Further litigation will be required to determine if Trump’s unconstitutional birthright citizenship order is allowed to take effect. Today’s ruling allows court orders to remain in place when necessary to protect the plaintiffs who have challenged the order, and makes clear that nationwide relief may be granted when class actions are certified. Plaintiffs of existing cases have already sought class action certification in response to this morning’s SCOTUS ruling. In the coming days, the litigation in those cases will determine the scope of this morning’s ruling."
