NEW: Oil companies face a skeptical SCOTUS in their effort to stop Boulder’s climate change lawsuit. With Justice Alito recused, eight justices questioned if they should be hearing the case and pushed back on Suncor Energy and Exxon Mobil’s broad constitutional arguments. Today, at Law Dork:

First take out of arguments: A rough morning for Suncor. Tough to find five votes to get past the jurisdictional questions. Even if they do, the constitutional arguments did not have support. That leaves the Clean Air Act preemption argument, under which (at least) some claims are likely to survive.
