I don’t always agree with @jadler1969.bsky.social, but I’ve always known him to be incredibly principled. He’s one of my favorite interlocutors, and when the Georgetown Law FedSoc asked me to suggest someone against whom to debate a couple of years ago, he was my first choice.

The Adler brief here is telling and suggests a major cleavage within the Supreme Court's conservative bloc. For the oil and gas industry to win here, the conservative justices would have to compromise on a lot of dearly held conservative principles. subscriber.politicopro.com/article/eene...

Good list of things to consider, adding to our ongoing debate about court reform. I'd go for most of them. I'm most skeptical on supermajority to strike down federal statutes. I'm not sure that would work as intended. (NB this is suggesting ideas other than expansion, not necessarily rejecting it.)

the Coin Flip Discourse was deeply mysterious to me until I finally saw the actual OP. The version I first saw offered the choice between 50K and a coin flip with “heads you get 2M, tails you owe 1M” stakes, and, it was like . . . . dag you guys love that risk 😂

No architect is ever going to ask me how to design a law school, but I think my top recommendations that relate to faculty would be (a) a centrally located faculty lounge with a kitchen and coffee and (b) faculty offices that are all exactly the same size. /end

And another thing: The 1957 printing of Webster’s 2d is not a contemporaneous dictionary. It’s a 1934 dictionary that was reprinted in 1957 with, maybe, a few minor corrections & an addendum. The “contemporaneous dictionary” enterprise is the source of much silliness in legal opinions.

a friend coined the term “yasslighting” to mean “when you are stupid wrong but your bad influence friend keeps telling you the opposite out of some bizarre obligation never to question you.” Gambling websites, manosphere toxic masc trainings, many cults, and more are all built to yasslight.
