“Judicial Regrets” is now published in Southern California Law Review! In it, I examine why judges sometimes come to regret their rulings, and how the legal system should respond to such regrets.👩🏾⚖️⚖️ southerncalifornialawreview.com/2026/09/24/j...

And DC folks: we’re speaking with the legendary @sifill.bsky.social about Supremacy at Politics and Prose on Friday at 7 PM. Join us!
Trump says the Court's rulings against him are "shockingly bad." But the rulings to worry about are all the ones putting him above the law. @daphnarenan.bsky.social and I are in Slate this morning on the difference between a Court that enforces acts of Congress and one that defies them.
John Roberts’ New Role Model Demonstrates Everything Wrong With the Supreme Court
If the court is curling up anywhere, it is at the feet of a presidency increasingly unchecked by law.

Today (9/10) at 10am ET, the Indiana Supreme Court will hear arguments in a religious liberty challenge to the state abortion ban. The mostly Jewish plaintiffs have so far prevailed in the state courts under a state Religious Freedom Restoration Act. Watch here:

One of my big academic rules: only write papers you really care about on topics you really care about. I try to follow this rule 99% of the time. This paper is one of the best examples of that, and I’m stoked it’s one step closer to being in the world. We’ve corrected proofs & you’ll have it soon!
All U.S. courts have judicial review, (aka the supreme power to tell other parts of the government they are behaving unlawfully) right? Actually, no. Some tribal courts don't. Read my latest in UChicago Law Review for more.
Professor Reese analyzes tribal court opinions on the topic of judicial review, using the underexplored body of case law to surface new insights about the institution of judicial review and about tribal courts themselves.
Are you a law student experiencing the dizzying process of moral decontextualization, as questions of power and justice seem oddly absent from the curriculum? If so, the Law and Political Economy movement might be for you. Check out this classic post on what LPE has to offer to new law students.

Every author hopes for a reviewer who reads generously, takes the argument seriously, and pushes back where it matters. Grateful to Daniel Immerwahr for this review of Supremacy in the New Yorker.
Has the Supreme Court Sandbagged Democracy?
A new legal history argues that the Justices should be stripped of their power to overrule coequal branches of government. It arrives at an awkward moment.

On this day in 1963, the National Council of Negro Women hosted a conference to reflect on the previous day’s March on Washington and plan for the future. Lawyer Pauli Murray criticized the lack of female speakers at the March. The group agreed on the need to fight both racism and sexism. #WeTheMen
This is truly heartbreaking. Dolly Parton was an extraordinary person and an irreplaceable champion of the working class. We are a better country because of her.
Lots of headlines on SCOTUS mail-in ballots ruling are wrong. A different injunction blocking the executive order still holds and the Post Office's proposed rule will probably be enjoined too. It ain't over yet. Steve Vladeck sets the matter straight: www.stevevladeck.com/p/246-making...
246. Making Sense of the Mail-in Ballots Ruling
The Supreme Court’s grant of a stay in one of the mail-in ballot cases is deeply wrong, but it’s also not the main event over whether Trump’s patently unlawful executive order can take effect.

Today I join the tenured faculty at Brooklyn Law School as the Ruth Bader Ginsburg Professor of Law. As a constitutional equality scholar, this honor is deeply meaningful, especially now. I’m so grateful to BLS for this appointment and to the law school community for their support. 🙏🏽
i expect that 1) will be the modal outcome.
Guaranteed: 1) Black girls will be harassed and demanded to be tested over and over again regardless of how competitive they are. 2) Winners from public schools will be relentlessly hounded by the parents and coaches of losers at private schools, with the goal of making them quit the sport.
The legal arguments for Trump's birthright citizenship executive order are vapid and embarrassing. Multiple lower court judges legit laughed DOJ lawyers out of the room. The fact that four Supreme Court justices twisted themselves into logical pretzels to buy it is a constitutional emergency.
The Constitution Is On Life Support
Four justices are prepared to stuff the Fourteenth Amendment’s promises in the garbage because Mister Trump demands it.

What have we lost? The Fourteenth Amendment is holding on by what is effectively a single vote, and Brett Kavanaugh provided a statutory roadmap for next time (and yes, there will be a next time). But, you're right, time to stop bitching!
So what? We won ! Move on and take the W- whining about some stuff you can’t control. What if we had lost? Stop bitching
Nothing bad in the United States is ever over, including constitutional things. These were the same arguments rejected over a century ago, and they'll be back again and we'll have to kill them again. Con law is basically about shotgunning zombies. rarely do you get a headshot.
Yesterday, I submitted the final manuscript for Respectability Politics to the University of Chicago Press. Excited for this next phase and proud of the hard work that’s gone into this book. Endlessly grateful for all the support and assistance I’ve had throughout this process. Happy Pride! 🌈
I wrote a book! The pub date is tomorrow! It's about age as a big factor in the distribution of power in American society (including, most important, the sociology of class)! It's full of facts and stories! Last day to preorder it-which would mean a lot! bookshop.org/p/books/gero...
