I’m in DC scheduled to give this talk today. But the organizers flagged slides in my deck that mention racism, structural gaslighting, New Jim Code and other themes that are off limits in the Land of the Free.

People keep thinking they can automate the type of admin work often done by women... bc they think their institution is a machine and not a brain. They think it can be recreated as a set of tasks executed w/ rules, and that we can skip the parts relying on relationships, memory, and judgment.

Many supposed news organizations are launching weird AI and tech products that fundamentally break the rules of journalism. Any interview is an individual conversation with its own terms between a source and reporter.
Earlier this week, I agreed to interviews with two USA Today journalists. They wrote fantastic articles about the Cornell case that I'm proud to have been a part of. What I did not know is that their employer considers interviews to proprietary and opens up recordings to be used by any journalist.

I saw this lawsuit and sighed a sigh that could probably be heard in the next county.
I literally said to Portia this morning, there's gonna be a shield law lawsuit soon. I didn't think it would be TODAY. Louisiana, Arkansas, and Alabama have filed a bill of complaint with the U.S. Supreme Court against New York, Massachusetts, and California. Hold on to your butts.
NEW / HUGE: Louisiana, Arkansas, Alabama sued nearly three dozen abortion pill providers + a pharmacy and The states asked the Supreme Court to be able to sue New York, Massachusetts, and California to challenge their telehealth shield laws @autonomynews.co storage.courtlistener.com/recap/gov.us...

OpenAI Accuses Plaintiffs’ Lawyers Of Paying For, Hiding, And Then Laundering Sketchy Key Evidence In AI Copyright Case
A ton of attention was paid recently to some offhand statements from OpenAI and Microsoft employees that surfaced in filings in the NY Times' ongoing case against OpenAI, which has been consolidated into a much larger class action lawsuit. As I argued earlier, that struck me as something of a nothingburger of a story, because...

Hi everyone! The latest update from the Lynne Freeman circus has arrived. It's a terrible circus and it appears to have only one act (bad faith conduct), but it does keep going on and on. Lemme explain what the NEW bad faith conduct is.
For those of you following along in the OTHER copyright case that has high stakes (but for many fewer people), the defendants have also now moved to sanction Lynne Freeman's counsel and hold them jointly and severally liable for attorneys' fees awarded. storage.courtlistener.com/recap/gov.us...
There’s something unnerving about getting to the end of a book on the Red Scare and only then finding out that you are a member of one of the groups that led to people being investigated and blacklisted. (That would be the National Lawyers Guild, for the record.)
