To expand on this a little, there are basically three situations: 1) GC complains about trans staff member, company does not know they are trans, no document exists that can prove they're trans, basically Don't Ask, Don't Tell. GC can try to sue, but it's basically unenforceable.
I think the actual answer is that companies are going to keep quiet because they're now stuck between two potentially exposing situations: 1) Lax enforcement - civil lawsuit by GCs. 2) Challenge trans/potentially trans staff - potential criminal prosecution for outing trans status.
Once again, I come back to the fact these guys have created a situation where one of the UK's leading, cis female athletes is scared to go to the loo alone, and the fact that they are celebrating this as a step forward for women's rights.
