As the Florida AG said yesterday, he opened a criminal investigation of Fauci. It's no longer hypothetical. I can't imagine arguing Fauci's invocation of the 5th is not legitimate after that.
Josh Chafetz@joshchafetz.bsky.social · 7d agoAs I said yesterday, if there's no plausibility bar to overcome, then no one would ever have to testify about anything in any criminal case without an offer of blanket immunity for everything they've done in their lives up to that point.

@alainleibman.bsky.social · 6d agoThere’s no “active” criminal investigation of which I’m aware, at least on the federal level. (A congressional hearing obviously does not qualify as one). But the prospect of a state-level prosecution is real enough to trigger his right to assert the privilege. 
The chances are quite good that the "number three" at DOJ who ordered Jim Comey to be illegally surveilled was Third Circuit judge Emil Bove. (He was nominated days later.) storage.courtlistener.com/recap/gov.us...

advised the ATSAIC that he “was asked by the SAIC to ping the cellphone of James Comey via
exigency.” Ex. D. [013417] He further added that he did so “with hesitation.” Id. The same
document indicates that an Assistant Special Agent in Charge (“ASAIC”) reported that “the # 3
guy at DOJ ‘wanted to ping the cellphone via an exigency request.’”3

7. Secret Service case records provided in discovery show that Mr. Comey’s cell
phone was electronically tracked that day as he and his wife drove north on Interstate 95 (“I-95”)
from North Carolina toward his Virginia home. The Comeys were also physically surveilled
during the trip, but trailing agents lost contact when the Comeys exited I-95 at one point to drive
toward the cemetery where the Comeys’ son is buried. The electronic surveillance captured the

Gorsuch seems to take the view that children of illegal aliens born in the US are birthright citizens because the parents are domiciled in the US
The Birthright citizenship ruling should be a wake up call to any Dem who is still on the fence about court reform. We are essentially one seat change away from the Court undoing Reconstruction by fiat.
Will be interesting to see how Weigel absolves "the Left" if Platner loses.

Among lots of things that are striking about Kavanaugh's opinion in the birthright citizenship case is the totally unnecessary dissent on the constitutional question. He could've just concurred in the judgment on the statutory question *without* discussing the 14A, but went out of his way to do so.
Kavanaugh is not only dishonest, he's incredibly stupid. He posits that a Consitutional amendment can itself be amended by changing circumstance. While at the same time arguing the Second Amendment is inviolable.

It's going to be a spoils system for "independent agencies." In his concurrence, Gorsuch made much of the fact that Humphrey was a politician, and certainly that was true. But independent agencies are not a spoils system now. But they will be going forward
