As the Florida AG said yesterday, he opened a criminal investigation of Fauci. It's no longer hypothetical. I can't imagine arguing Fauci's invocation of the 5th is not legitimate after that.
As I said yesterday, if there's no plausibility bar to overcome, then no one would ever have to testify about anything in any criminal case without an offer of blanket immunity for everything they've done in their lives up to that point.

There’s no “active” criminal investigation of which I’m aware, at least on the federal level. (A congressional hearing obviously does not qualify as one). But the prospect of a state-level prosecution is real enough to trigger his right to assert the privilege.

The Birthright citizenship ruling should be a wake up call to any Dem who is still on the fence about court reform. We are essentially one seat change away from the Court undoing Reconstruction by fiat.

Among lots of things that are striking about Kavanaugh's opinion in the birthright citizenship case is the totally unnecessary dissent on the constitutional question. He could've just concurred in the judgment on the statutory question *without* discussing the 14A, but went out of his way to do so.
Kavanaugh is not only dishonest, he's incredibly stupid. He posits that a Consitutional amendment can itself be amended by changing circumstance. While at the same time arguing the Second Amendment is inviolable.
