The fundamental mistake that the conservative legal movement made in looking at the Warren Court was assuming that it was all power and zero parts persuasion, so all they had to do was capture the institution. They were, I think, half right, but that other half is very important.

If I had to guess right now (and it is premature!) I'd say the Supreme Court is going to strike down Trump's tariffs. All three liberals are clearly against the government. Barrett too. Roberts leaning that way. And we haven't even gotten to tax-hater Gorsuch yet.

Soft prediction, feel free to own me if wrong: by 2029 there’s a Dem in the wh. They will be elected in part on promise to hold the second trump admin accountable for many crimes. Shortly after getting in, median voter public sentiment will turn to “just move on, we’re done with that”
