As the director of a historical video game preservation institution, and someone who has dedicated his entire adult life to this cause, this is accurate. We have attempted to work with the industry's trade organization to find a legal path forward, but they refuse to offer a meaningful alternative.

This is amazing precisely because this billion-dollar mistake rests on a misunderstanding (and probably related hype) of what LLMs can do relative to their training data. I guess every industry will just keep finding out what is NOT in the training data? But there are shortcuts to find out.

Termination without cause in Japan is complex and workers have a lot of rights and protections we don't in the US. If Japan had employment laws as weak as ours, Nintendo would undoubtedly lay off workers just the same. It's not management's benevolence or farsightedness, it's labor law.

You know what Nintendo does when they have a surplus set of devs from cancellations or production ending? Put them on other projects. The ability to redeploy headcount while keeping teams together over time is like, the main strategic benefit of scale in the game industry
