Is the justiciability of Article 2 TEU an act of self-empowerment by the Court? LUKE DIMITRIOS SPIEKER argues that its activation is rather the result of a collective interpretation by the European society. verfassungsblog.de/a-european-s... @mpil.de

⚖️🌈 The court’s ruling raises serious concerns regarding the sovereignty of member states and constitutional identity. In light of these concerns, the Hungarian government will not implement the ruling, writes Viktor Orbán in a letter, he sent today to the President of the Republic.

The CJEU sees the Hungarian anti-LGBTIQ* law as stigmatisation that may foster hateful conduct and thus violates European values. ARMIN VON BOGDANDY and LUKE DIMITRIOS SPIEKER argue that with this decision, the Court advances European society. verfassungsblog.de/the-red-line...
Hungarians deserve every congratulations for giving Peter Magyar a bigger margin than Orban has ever gotten in all of his rigged elections - and this within the system that Orban rigged. Magyar now has a constitutional majority to undo Orban's constitutional prison and govern as a democratic leader.
Orban called Magyar to congratulate Magyar - and admitted defeat to his supporters. It's over. Peter Magyar and his Tisza Party wins with such an overwhelming victory that he has two-thirds of the seats in the parliament and can undo Orban's autocratic legalism!

A long read on national competences and the @eucourtofjustice.bsky.social in the @euconst.bsky.social I tried to make sense of and refute claims that the Court must respect national competences when interpreting substantive EU law (many will be reminded of the “retained powers” formula…).
Stop the competence confusions, Dimitri Spieker argues in his new article. The vertical division of competencies does not and cannot constrain the CJEU's interpretation of EU law. Read the piece Open Access at: www.cambridge.org/core/journal...
Good to see @europarl.europa.eu refer to principle of solidarity in its resolution on Hungary calling for triggering of Art. 7(2) TEU. With @dimitrispieker.bsky.social and Ulrich Karpenstein, we argued that new Art. 7 procedure should be initiated against HU based on breaches of solidarity in CFSP

For @sarahganty.bsky.social & I it was an Article 2 TEU #pride‼️ Respect the values, Orbán‼️🇭🇺🏳️🌈Hungary is too beautiful and loving to flush it down the drain with illegal nonesense‼️ @ilgaeurope.bsky.social @ceudeminst.bsky.social @weareceu.bsky.social
🌈🇭🇺 My short POV from the historic Budapest Pride: part celebration, part anti-gov't protest. For context: men in zebra dresses reference the zebras kept near the Orbán family’s mansion. Marchers also mocked gay Orbán ally ex-MEP József Szájer and the PM’s son Gáspár (“I came because of Gáspár”).

Tackling the Union’s “Orbán Problem” Now
verfassungsblog.de
Transposing EU-wide sanctions against Russia into national law could be a way to undercut Orbán’s ability to veto their rollover, a handful of governments think. Others are hesitant to make any moves that could undermine a common front.
On @verfassungsblog.de I call for tackling the Union's "Orban Problem" NOW! 📣 The momentum has never been better! The @ec.europa.eu should bring a new proposal under Art. 7(2) TEU, which couples restraint and boldness.
The EU is facing an “Orbán problem”. That much is clear. LUKE DIMITRIOS SPIEKER argues that the Commission should submit a new proposal under Article 7(2) TEU focusing on breaches of solidarity and threats to the Union’s security: verfassungsblog.de/tackling-orb...
