Here's the argument that the 2024 GOP law is unconstitutional & Beshear has the right to appoint a senate replacement when one dies. But winning the legal challenge is not the point. Beshear acting is about showing Democrats as fighters, win or lose. It's about giving people something to vote for.
It’s especially galling b/c you know if Mitch were in Bershear’s shoes, he would have called for a special election after 2 weeks of this nonsense.
The Kentucky Constitution does not say the governor must choose from a party-provided list for U.S. Senate vacancies. That was created by statute in 2021. That's the statute that Beshear would be challenging.
If Andy Beshear does not push this to a conclusion that either has him appointing McConnell's replacement, or McConnell reappearing, Beshear will be out of Democratic politics. We need rabble-rousers, not the same quiet, proper Dems who keep losing.
