NEW: The Trump admin is proposing to impose a $103,265 fee on all H-1B visa petitions which are subject to the annual cap of 85,000 visas. The fee would apply to all those selected in the annual lottery who go on to file H-1B visa petitions. There is a 30-day comment period which starts tomorrow.

AGENCY: U.S. Citizenship and Immigration Services (USCIS), Department of
Homeland Security (DHS).
ACTION: Notice of proposed rulemaking.
SUMMARY: The Department of Homeland Security (DHS) proposes to establish a
$103,265 fee, payable at the time of filing, for all H-1B cap-subject petitions, including
those eligible for the advanced degree exemption, which would be imposed in addition to
all other applicable fees or payments. This fee would serve as a dedicated revenue
mechanism to help recover a portion of the federal government’s costs of administering
the lawful immigration system, including activities carried out by DHS, the U.S.
Department of Justice (DOJ), the U.S. Department of State (DOS), and the U.S.
Department of Labor (DOL).
DATES:
Submission of Public Comments: Written comments must be submitted on or
before [INSERT DATE 30 DAYS AFTER DATE OF PUBLICATION IN THE
FEDERAL REGISTER]. The electronic Federal Docket Management System will
accept comments before midnight eastern time at the end of that day.

I just got a FOIA back about the EOIR's Office of Chief Administrative Hearing Officer that raises really serious questions about whether that agency is functioning lawfully. My initial review says they're not. There's no functioning CAHO. A thread, because the documents are kind of wild. 🧵

No you’re not reading that wrong. They aren’t required to provide the terms on an Asylum Cooperative Agreement to decide that you are subject to the terms of an Asylum Cooperative Agreement even tho the reg requires the IJ to determine whether you’re subject to the terms of the Agreement.

i was reminded that i made a helpful tool if you're somebody who files FOIA requests for email logs (as a spreadsheet) upload them to GraphEmails.com and you can generate network graphs of who's emailing each other, which you can style and filter (or use to filter the log)

In this clip, Kash Patel says the grand jury heard evidence that Comey deleted the '8647' post and apologized. Neither fact appears in the indictment. Hmm. Did the FBI director just disclose evidence presented before a grand jury?

Just got a BIA Briefing Schedule in a case where the Board received the transcript in May 2023. Three years ago. The case has just been sitting at the BIA waiting for the clerk's office to issue this two-page briefing schedule for three years. For no reason. We get 21 days to file our brief.

There is a hearing tomorrow at 11 AM in the lawsuit where the AUSA in March informed the court that ICE had been lying to them all along about the import of their court arrests memo. The case is African Communities Together v. Lyons (1:25-cv-06366).
