As much as I want to say that Capital One closed Trump’s accounts because he was laundering money, failing AML/KYC review does not necessarily mean that. Financial institutions decide all the time whether there’s a potential AML/OFAC violation and make risk decisions based on that potential.

Having previously been in-house at a financial institution, I cannot agree with this more. The amount of effort, overhead cost, and actual desire to fund compliance at major banks would be an anathema to Musk. Not that people on BlueSky would be inclined to bank there, but you never know.

I stand by everything I said previously. At least with a major bank I know there is oversight, deposit insurance, and regulation for things like anti-money laundering.

Practice tip: if you're in litigation with a company, you cannot reach out directly to the employees of said company (especially to their personal cell phones) to interview them when you know the company is represented by counsel.
