Debut novel THE SLIP out now from Simon & Schuster. Winner of 2025 Kirkus Prize for fiction. Paperback 6/23/26.

The Birthright citizenship ruling should be a wake up call to any Dem who is still on the fence about court reform. We are essentially one seat change away from the Court undoing Reconstruction by fiat.

fundamentally, Alito and Thomas believe that the 14th Amendment established a hierarchy of citizenship or allowed the elected branches to do so. but that is totally ass backwards! it was explicitly written to *preclude* any hierarchy of citizenship. it is right there in the text!

I Am Not A Lawyer™. (Though I spent a year studying law) Neither is @joshtpm.bsky.social But we both know something about US history (him w PhD), including about anti-Asian immigrant wave of late 1800s. And agree w him 100% here. That this was 5-4 is a relief. That it was not 9-0 is an emergency.

In a way one of the clearest proof points of the citizenship clause is the United States v. Wong Kim Ark case, 1898. And not because it was the precedent. It is difficult to grasp just how racist the US was in 1898, both in a "hard" biological as well as a general cultural sense. Anti-Asian ...

I don’t have much to say about Slaughter, and honestly I think we do too much justice to the Roberts Court by treating its opinions like serious judicial reasoning. But I will say that it’s striking how openly the court treats congressional oversight as somehow antithetical to democratic government

Slaughter belongs in the anti-canon, a decision so egregiously wrong it has zero precedential value and is self-discrediting. It is not a plausible reading of a constitutional ambiguity, it is constitutionalizing the structure of an autocracy.

Our independent federal regulatory agencies were created to protect the public from corporate harms. The only reason to end these protections is to give corporate America even higher profits by shifting the risks of harms to individual people. The shame of the John Roberts court.

Dems have to run on this hard. Do not let the RFK types try to spin what his own party just signed off on here. Actual Monsanto, the comic book villain of Adbusters days, was shielded from liability over poisoning Americans. I don't care if it's slopulism: this Supreme Court wants you dead.
