So Games Workshop needs to respond to this (IMO) by both attacking the claim that anything they did infringed on the wereshark, and making it as clear as possible that they are not (in the process) claiming ownership of the wereshark. Because that would be bad.

But you also want to be careful in how you approach things. Especially if you are WOTC, or Games Workshop, or Sony, or CD Projekt, or any other large company that frequently sees its every move inexpertly dissected by inexpert influencers hunting clicks. There are things you want to avoid.

You don't, for example, want to only argue that the arguments about access are nuts. Because if the judge (for example) decides that the access argument is unlikely but not improbable, just like that you're into mid-6 figures of discovery and a long food fight.

This actually turns out to be a more difficult question than you'd expect. Why? Well, it's a copyright complaint. Responding to copyright complaints is challenging. In part, that's because you really, really, don't want to leave arguments on the table.

But, a quick summary: Mr. Chan has filed a very batshit complaint against Wizards of the Coast. The complaint alleges that Wizards of the Coast stole - in direct contravention, as we shall see, of the laws of causality - his Wereshark creation. Nuts, right? If you are WOTC, what do you do?
