Further advice: if you are served with a without notice interim HDCA order that compels you to do certain things do them straight away and comply with it. You have your chance to challenge the order at the full hearing. Get superb legal counsel knowledgeable in the HDCA. Don’t be a fool!!
It’s the position of Rights Aotearoa that the HDCA law is due for a review to ensure it’s fit for purpose. We don’t think it’s a bad law like the FSU does, but agree a review could be useful to ensure it’s working correctly.

A friend had a spare ticket to the Wellington Opera performance of Manon by Massenet last night and invited me. It was sensational-one of the best opera performances I have been to in NZ. Matthew Ross and Hannah Caitrin Jones are the driving force behind the opera company and deserve immense praise!

I actually would really love to stop seeing discussions about whether someone who has caused immense grief and harm to a lot of people I care deeply about is the lesser of two evils thanks

It's wild to me that anyone is pointing at the US military's weird testosterone thing as some sort of parallel to transition care Bodily autonomy is the whole bloody thing about transition care. A government telling you "you must have these hormone levels" is so far on the opposite end of the scale

This is very interesting. Corrections lawyers obviously think Gender is included under Sex in the HRA (hence the settlement), but Crown Law acting for Min of Health today in the High court might be arguing differently! I am not at the hearing so can’t confirm. Their arguments will be known soon.

Day two kicks off at 10. Today we're likely to get into the discrimination arm of the case and thus the matter of sex in the HRA. After lunch the Crown begins their response.
It’s good that PATHA v Minister of Health will almost certainly determine the validity of the crown law 2006 opinion. As we will need that for a BORA declaration of inconsistency challenge if the Definitions bill goes ahead. I will try and lead that charge!
Victoria, our lawyer, started this morning with words from the people who most often don't get to speak about these decisions - trans rangatahi and their whānau. There's some incredibly brave and proud rakatahi across Aotearoa who have lent their voices to this case and I'm eternally grateful.
Despite Goldsmith’s attempts at institutional capture it is good to see that the Human Rights Commission still broadly believes in Human Rights!

Predicting judicial review outcomes is an absolute mug's game. But the judgment on interim orders revealed 2 or 3 quite strong grounds of review, which will now be argued in full over the next 3 days. Again not predicting outcomes, but happy to say I think a very real chance of success.

Jennifer@jennifilm.nz · 3w agoThe Human Rights Commission has also intervened in this case to argue for a broad definition of sex in the Human Rights Act that includes gender, in line with the last 20 years of established practice in Aotearoa.
