People kicked off about medical trials on non consenting research subjects and eventually we won the helsinki declaration on medical ethics. There's no cop in the world in charge of enforcing the helsinki declaration. It's just a formalisation of the idea that you need medical consent for research.

When I'm discussing and appealing to a legal principle it's less about "because that's illegal" or "there should be a cop to rescue me from this indignity" and more that the language of human rights laws is the language of the battlefield human rights activists have fought and won concessions over.

What Féile an Phobail row has shown is that women’s rights are at risk — just not from a tiny trans minority Belfast Telegraph27 Jul 2026ALLISON MORRIS I’ve thought long and hard about commenting on the controversy over the cancellation of the Women’s Rights Network (WRN) event at Féile an Phobail — not because I don’t have an opinion, but because it is a debate that attracts the most toxic elements. WRN NI was not a group I was familiar with beforehand, so I did some research. No speakers were listed in the Féile programme for the planned event, which in itself is odd as there are for almost every other of the 90-plus debates and discussions. The group has since announced who its speakers were to be in a series of online posts. My research took me down quite the rabbit hole — a who’s who of the anti-trans movement not just on this island but Europe-wide. I don’t pretend to understand their motivation. In fact, I remain baffled as to why in one of the most dangerous places for women to live in Europe, the group — which has spoken out about femicide before — is obsessing about a small minority instead of the actual dangers we face from domestic violence and femicide. I have worked for decades covering violence against women and girls in all the distressing forms that takes. I know the names of every woman and child murdered in Northern Ireland in the last 10 years without even having to look them up. Not a single one was caused by a trans woman — I checked the list twice just to be sure. None of them were murdered in a public toilet either, which having looked at the online posts of WRN and their many affiliates, is apparently the most dangerous place on earth for women, with trans predators lurking in every cubicle. Apart from the absurdity of much of the group’s argument regarding the perceived dangers of trans women, the claim that women are being silenced by Féile is the most disingenuous of them all.

As the British government delivers its guidance on “single sex spaces,” here is a painfully clear reminder from Australia that it’s possible (and actually pretty basic!) to pass legislation that ensures trans people are not discriminated against and are recognised in their gender. It’s not radical.

Australia’s Federal Court offers a lesson in how courts can read equalities legislation in a way that recognises “sex” is not a term fixed by biology or birth while also challenging the discriminatory effects of gender stereotyping and policing. The UK Supreme Court could learn from this approach. 🏳️‍⚧️

It follows that I agree with Ms Tickle that the appropriate comparator for Ms Tickle as a transgender woman seeking access to the Giggle App under s 5B(1) is a cisgender woman seeking access to the Giggle App, and not a cisgender man. This approach is consistent with my findings above that part of the discriminatory mischief which the 2013 Amendment Act was intended to address was treatment of transgender people in accordance with their assigned sex at birth, rather than their gender-related self-identification. A comparison between a transgender woman and cisgender man in a case such as the present would, in effect, re-enact that discrimination and invalidate the gender identity and/or gender presentation of a transgender woman. Such an approach is in tension with the protective purposes of the SDA in relation to gender-diverse people.
