Schließlich urteilt der Gerichtshof, dass Ungarn die in Art. 11 der Charta der Grundrechte verankerte Meinungs- und
Informationsfreiheit verletzt hat, und zwar zum einen durch die Entscheidung über die Ablehnung der Verlängerung und
den Erlass des Mediengesetzes und zum anderen durch die Entscheidung über die Ungültigerklärung und die betreffende
Ausschreibung. Dem Gerichtshof zufolge kann nämlich jede nationale Maßnahme, mit der der Zugang von
Sendeunternehmen zu Funkfrequenzen eingeschränkt oder begrenzt wird, einen Eingriff in ihr mit der
Rundfunkfreiheit verwandtes Recht auf Medienfreiheit darstellen. Der Gerichtshof stellt insoweit fest, dass die
Verstöße und Versäumnisse, die Klubrádió im vorliegenden Fall vorgeworfen werden und die sowohl der
Ablehnungsentscheidung als auch der Entscheidung über die Ungültigerklärung zugrunde liegen und diesen
Radiosender konkret daran gehindert haben, seine Tätigkeit im Rundfunkbereich fortzusetzen, entweder
geringfügige formale Ungenauigkeiten oder Aspekte betreffen, die als solche nicht dazu führen dürften, dass ein
Radiosender seine Tätigkeit nicht fortsetzen kann.

In today’s Chamber judgment1 in the case of Morawiec v. Poland (application no. 46238/20) the
European Court of Human Rights held, unanimously, that there had been:
a violation of Article 6 § 1 (access to court), Article 8 (right to respect for private and family life) and
Article 10 (freedom of expression) of the European Convention on Human Rights.
Ms Morawiec is a judge. Since 2018 she has been the President of the Judges’ Association Themis,
which has publicly criticised the Government’s reforms affecting the judiciary.
The case concerns rulings by the Disciplinary Chamber of the Supreme Court (“the DCSC”) relating to
Ms Morawiec’s immunity from prosecution and to her suspension from judicial duties, which she
argues were taken in reaction to her public criticisms of the judicial reforms and a successful civil
action she had brought against the Minister of Justice in 2017.
The Court held, as it had in previous cases, that the DCSC was not a “tribunal established by law”. It
found that the measures taken by the authorities to lift Ms Morawiec’s immunity and to suspend her
from judicial duties could be characterised as a strategy aimed at intimidating her and that those
measures must have had a “chilling effect”, discouraging not only her, but also other judges from
participating in public debate on legislative reforms.

Violation of judge’s right to freedom of expression on account of sanction for Facebook posts of public interest
In today’s Grand Chamber judgment1 in the case of Danileţ v. Romania (application no. 16915/21) the European Court of Human Rights held, by 10 votes to 7, that there had been:
a violation of Article 10 (freedom of expression) of the European Convention on Human Rights.
The case concerned the freedom of expression of a judge, who had had a sanction imposed on him by the National Judicial and Legal Service Commission (Consiliul Superior al Magistraturii – CSM) for posting two messages on his publicly accessible Facebook page.
The Court reiterated that, where democracy or the rule of law was under serious threat, judges were entitled to speak out on matters of public interest. Remarks made in such a context generally enjoyed a high degree of protection.
It then considered that the applicant’s posts had not upset the reasonable balance between, on the one hand, the degree to which the applicant, as a judge, could be involved in society in order to defend the constitutional order and State institutions and, on the other, the need for him to be and to be seen as independent and impartial in the discharge of his duties. The first message had aimed to defend the constitutional order and preserve the independence of State institutions. The second had related to the functioning of the domestic justice system. They had thus both concerned matters of public interest about which the general public had had a legitimate interest in being informed. In the reasons given by the national authorities, there was nothing to indicate convincingly how his remarks had allegedly disrupted the proper functioning of the domestic justice system and impaired the dignity and honour of judicial office or the public confidence that such office should inspire.
