"ECONOMIC RETRENCHMENT"
ON THURSDAY, JULY 23RD, THE UNION FOR TRANS LIBERATION (U4TL) MET WITH ADVOCATES FOR TRANS EQUALITY'S (A4TE) EXECUTIVE LEADERSHIP TEAM (ELT) FOR THE FIRST TIME SINCE A4TE ANNOUNCED
"ECONOMIC RETRENCHMENT" AND
"POTENTIALLY ELIMINAT[ING] SOME POSITIONS" TO THE PUBLIC-AND ELT SHOWED UP UNPREPARED.
OUR UNION MEMBERS ORGANIZED, RATIFIED OUR CONTRACT, AND CAME TO THE TABLE YESTERDAY READY TO WORK. WE WERE SURPRISED WHEN MANAGEMENT WAS UNABLE TO ANSWER BASIC, SPECIFIC QUESTIONS ABOUT THE FINANCIAL HEALTH OF OUR ORGANIZATION. IDEALLY, THEY WOULD HAVE BEEN PREPARED TO ANSWER THEM BEFORE ANNOUNCING POTENTIAL LAYOFFS TO THE ORGANIZATION AND THE PUBLIC. STAFF AND THE COMMUNITIES WE SERVE DESERVE BETTER THAN THAT.

A4TE'S ANNOUNCEMENT OF POTENTIAL LAYOFFS HAS CREATED HURT, FEAR, AND UNCERTAINTY AMONG OUR MEMBERS. WE RELY ON A4TE FOR OUR LIVELIHOODS, OUR HEALTHCARE, AND SUPPORTING OUR FAMILIES. WE HAVE DEDICATED OUR SKILLS, OUR PASSION, AND COUNTLESS HOURS TO THIS ORGANIZATION IN SERVICE OF THE TRANS COMMUNITY—AND THE MAJORITY OF US ARE TRANS OURSELVES.
THE THREAT OF LAYOFFS IS DAUNTING, BUT WE ARE ORGANIZED AND READY TO PROTECT OUR WORKERS.
U4TL RECENTLY RATIFIED OUR COLLECTIVE BARGAINING AGREEMENT (CBA), WHICH SPELLS OUT EXACTLY WHAT MANAGEMENT MUST DO BEFORE ANY LAYOFFS MOVE FORWARD: SHARE INFORMATION, BARGAIN OVER
ALTERNATIVES, AND WORK TOGETHER TO FIND A WAY FORWARD THAT PROTECTS PEOPLE'S JOBS.

WE ARE NOW BEGINNING THAT PROCESS — WHICH STARTS WITH REQUESTING A LOT OF INFORMATION FROM MANAGEMENT —AND WE WILL CONTINUE TO SHARE VERIFIED UPDATES AS WE MOVE FORWARD. "On May 7, 2026, NYU Langone Hospitals (“NYULH”) was one of several institutions that received a grand jury subpoena from the U.S. Attorney’s Office in the Northern District of Texas. Among other requests, the subpoena directs NYULH to provide information pertaining to patients under the age of 18 who received gender affirming care at NYULH between 2020-2026, as well as the names of NYULH providers and others who were involved in offering such care at NYULH in that timeframe.
Pursuant to the New York State Shield Law, any entity in New York State that receives a request for information regarding legally protected health activity, such as the provision of reproductive health care or gender-affirming care, must make a reasonable attempt to notify the individuals to whom that request pertains at least 30 days before complying with or providing information in response to the request. More information about the Shield Law is available here.

MOTION TO STAY OR FOR TRANSFER OF VENUE
The United States of America respectfully moves to stay this action, or to transfer venue of this action to the Northern District of Texas, under the "first-to-file" rule. Plaintiff
has made clear that this action seeks to undo a valid order entered by a district judge in
the Northern District of Texas enforcing this very same subpoena (25-1431-032) on the very same entity (Rhode Island Hospital). Doc. 1 at 2. In addition to other problems with
the Plaintiff's suit - addressed in the Government's response filed later today — the first-
filed rule counsels against this Court adjudicating this matter. Because the United States' enforcement action was filed first and the lawsuits are functionally the same, the first-filed court - in this case, the Northern District of Texas - must determine which action should
proceed. Therefore, this Court should stay or transfer this action in order to permit the
Plaintiff to ask the Northern District of Texas to make that determination.

TEXT ORDER. The Government's Motion to Stay or Transfer Venue (ECF No. 8) is DENIED. When deciding whether

to apply the first-to-file rule, courts must consider: "(1) which action was filed first; (2) the similarity of the parties; and

(3) the similarity of the issues." Waithaka v. Amazon.com, Inc., 404 F. Supp. 3d 335, 350 (D. Mass. 2019), aff'd, 966 F.3d

10 (1st Cir. 2020). While the Texas enforcement action was filed first, the remaining factors are not satisfied. The parties

are not similar: the Child Advocate was not a party to the Texas proceeding, had no notice of those proceedings, and had

no opportunity to be heard there. Rhode Island Hospital, the only party before the Texas court, is not a party here. The

issues are not similar: the Texas court adjudicated the enforceability of the subpoena as between the government and

Rhode Island Hospital; this Court is asked to adjudicate the independent constitutional privacy rights of minor patients

who were never before any court. Those claims were neither raised nor considered in Texas and could not have been, as

the affected parties were absent. The first-to-file rule does not apply. So Ordered by District Judge Mary S. McElroy on
