This is such an important point.

The entire project of mainstreaming and adopting the term of "biological sex"since the 1970's has been a reactionary one meant solely to exclude trans people from society and the protection of its laws.

And therein lies the heart of what the Court was doing. They were trying to define sex by what it isn't rather than what it is because the purpose was solely to exclude trans people from the protection of the law. They'll contort the law and their own judicial philosophies to do it.

"Biological sex" is fundamentally a retronym like "acoustic guitar" or "snail mail" that adds an adjective to a word whose meaning has shifted over time to try and refer to something older. The first legislative language to adopt it was North Carolina's bathroom ban in 2016.

The term "biological sex" was adopted widely only in the last decade as a reaction to mainstream acceptance of trans people. It was rarely if ever used before that. By any metric, from legislative usage to search query usage, it's plainly evident this is a novel term only made popular by the right.

I think people think we're exaggerating when we say the widespread use of the term "biological sex" as a term itself isn't organic. This data isn't anomalous, it comports with everything we've seen about the specific use of the term.

i'm remembering being back in high school, talking to a therapist about my gender, and one of the big things that stressed me out was wondering if i could still run track if i transitioned. my therapist did some research and found a bunch of positive resources that said i still could. i'm sad today

Thinking about the social media ban and wondering where kids will shift if not on mainstream channels. When I was a teen in the late 80s - living in a small town, into Sarah Records and my bloody valentine - there were pen pal listings in music magazines and a whole fanzine/floppy disc subculture.
