Having slept on it, I am far more troubled by this settlement. The government should not be able to use its power to bully a defendant into silencing lawful third party speech. That's what the govt did to bookstores in Bantam Books. The Court held that it violated publishers' 1st Amendment rights.

This thread has my scattered takes on the Meta settlement agreement, at first skim. It covers a lot of the big pieces, despite beginning with a more tangential interest of mine about the MPA (nee MPAA). I think a settlement like this should be unconstitutional. But it's a weird new legal Q.

Meta has been advocating for it for a long time because they know how accurate and secure age verification isn't and desperately want the error rate to be someone else's problem so they stop being the scapegoat

This one point is proving remarkably challenging to get across: ALGORITHMIC FEEDS ARE EDITORIAL You wouldn't expect to do well pitching your ideas to a newspaper or TV that hates you. Why expect anything better from X or Insta, which are openly authoritarian media?

I have a longer thing I'm working on about this, with more data and stuff, but the key thing folks need to know: anyone on the left *CANNOT WIN* with any kind of content on platforms where the right owns the algorithm. Not just in politics — in entertainment media, or anything else.
