Oh I like this idea! My instinct is "make those responsible pay," but if that doesn't happen, a support fund could let others chip in - the 3 WA law schools, local bar assns, big & medium-size firms (subsidizing solos & small firms), big WA companies who have lawyers in WA (AMZN, MSFT, Costco, etc.)

I'd like to see free test prep courses offered to whoever wants one, but BarBri et al. will want somebody to foot the bill, and while it'd be cool if WSBA/NCBE did so, see above re: "how much $ do those orgs actually have" (vs. how much will they *pretend* to have no $ so as to avoid accountability)

1: waive their bar dues for at *least* the 1st year. WSBA & NCBE pay back all fees paid. on 2, get test prep companies & law firms on board to support test takers, but "what's in it for me?" in an ideal world, WSBA/NCBE pay for $ wasted on travel, pay for a 2nd test prep course & 2nd exam sitting

Even if #1 scenario, option to sit in September for free with travel/hotel/food covered. Some need/want to port their scores. If #2 scenario, a retake in September with a lower pass threshold and travel/hotel/food covered. In both scenarios, a refund of exam costs and (ahem) the tech fee.

Call for ideas re Wash. Bar Exam Disaster: 1. Assuming Sup. Ct. grants diploma privilege, what *else* do we need? What should we advocate for, specifically for these test takers? 2. If Sup. Ct. does *not* grant privilege, what next? What do takers need? What do we advocate for? Organize around?

The Washington Supreme Court should absolutely grant emergency diploma privilege. As far as I can tell, this is the worst bar exam disaster of all time. Has one ever been cancelled on its first day before, due to completely foreseeable tech issues? Give these applicants their licenses already.

Update: Dean Lawson of @uwlaw.bsky.social wrote to our Supreme Court earlier today. She requested the Court grant "diploma privilege . . . to avoid any additional harms to these graduates, specifically to prevent any delay in their careers or admission to the practice." 1/

My letter to the WA Supreme Ct earlier this evening urging diploma privilege as a remedy for the disastrous failed attempt at administering the July 2026 WA Bar Exam, and its unwise postponement to September. No altogether good options, but equity and fairness require diploma privilege for the… 1/2

She's right. Asking these students to put their lives on hold for another two months and have to continue studying is cruel. That assumes they are able to attend the bar exam in September and ignores the financial costs. There's no need to be cruel.

I just had a call from a colleague about this. As @djsziff.bsky.social posts also, all of the students are in Yakima for this (about a 2.5 hour drive from the Seattle area, where 2 of the 3 WA law schools are located and likely the majority of test-takers); they are in hotels out there.
