What 'moderation' really means is adopting the views of a very small group of loud, centrist writers and their big business backers, and is increasingly out of step with (a) the big problems in the US and (b) the polling on what Americans say are the biggest problems they want government to fix.

Yes, Congress should be able to do these things. A court this contemptuous of Congress deserves to be packed by Congress, not only to correct these disastrous precedents but also because Congress needs to show both Article II and Article III who’s boss.

If Popehat is permanently banned because of this post, I’m genuinely concerned about the viability of this platform. Hopefully, someone like @masnick.com knows more about what’s happening and whether this is just a temporary suspension

Banning Popehat was a profoundly stupid move by Bluesky. Moderation is a very difficult job at this kind of scale, and I tend to grant lots of leeway for that reason. But this move was simply indefensible.

The upshot here is that a prisoner cannot sue a corrections officer who violated his religious liberty under a federal statute that guarantees free exercise behind bars. But the implications sweep way beyond this case to seriously neuter other spending clause legislation. A REALLY bad decision.

I’m sorry, if the position of Republicans is that FISA isn’t important enough to pass unless they also get tons of priorities they can’t otherwise enact, and that DNI is fine in the hands of an unqualified crony, then both should be allowed to die and the consequences are on them.
