Natürlich kann man behaupten, Islamismus sei eine Form von konservativer oder rechtsextremer Ideologie. Man kann sich aber auch fragen, warum weder Sicherheitsbehörden noch der Großteil der Extremismusforschung diese Einordnung teilen – und ob sie dafür vielleicht gute Gründe haben.

Well, natürlich entscheidet am Ende ein Gericht über das Verbot. Doch gerade weil die Einleitung des Verfahrens politisch beschlossen wird, werden auch der Prozess und das Urteil zumindest teilweise politisch wahrgenommen. Der Anschein eines Oppositionsverbots lässt sich nie ganz ausräumen.

Das politisch effektivste Argument gegen das Verbot von Parteien ist, dass die Antragsteller so die Opposition verböten. Doch eine Partei hat es vollständig selbst in der Hand, ob sie verfassungswidrig ist. Und es sind gerade nicht ihre Gegner, die das Verbot aussprechen, sondern das BVerfG.
