I said it at the time (and before!), but I truly believe that American voters electing Donald Trump for a second term in 2024 was the dumbest and most self-harming choice made by an electorate in the history of humanity
But far more importantly, the voters make no appearance whatsoever in Justice Alito’s reasoning. He, like the government, does not dispute that using the rule in 2026 would disenfranchise millions of our most vulnerable people. He doesn’t care. It’s despicable and antidemocratic.
Still, I think the Republicans won on their essential goal, which was CHAOS. Put it like this: *I’m* sure as hell not going to mail in a ballot. I might still vote early, but in-person for sure.
Others have said this but it’s truly insane that Brett Kavanaugh, lover of the major questions doctrine, thinks there’s a good chance USPS can use a vague grant of authority over mail processing to radically alter absentee voting procedures in all 50 states without congressional approval. Come on.
It’s notable that the majority says BOTH that Trump’s USPS rule is likely illegal AND the equities counsel against implementing it. Seven justices are sending a pretty clear message to Trump that this kind of sloppy election subversion is a bridge too far. That’s moderately encouraging?
And, of course, Justice Alito repeats the false claim that USPS interference with mail ballots is needed to "better detect election fraud," a statement for which there is absolutely ZERO EVIDENCE in the record.
