SUBJECT: Adjustment of Status is a Matter of Discretion and Administrative Grace, and an Extraordinary Relief that Permits Applicants to Dispense with the Ordinary Consular Visa Process
Purpose
This memorandum reminds officers and the public that adjustment of status under section 245 of the Immigration and Nationality Act (INA) is a matter of discretion and administrative grace not designed to supersede the regular consular processing of immigrant visas. U.S. Citizenship and Immigration Services (USCIS) reaffirms this consistent and longstanding approach and declares as a matter of general policy its intention to faithfully apply the statutes consistently with this understanding.

I love the form the NYTimes “bothsidesism” takes in this article. On one hand, professors worry that something they or a student says might put them on the radar of authorities and then deported. On the other hand, I don’t have to feel imaginary pressure to say “menstruating persons” anymore!

Christopher Kutz, a law professor at the University of California, Berkeley, said he is self-censoring to protect students, particularly those in the United States on visas. He said he worried that they might write or say something that could end up being turned against them.
"I'm not going to change what I say, but I will try to make sure the assignments don't invite students into making statements that could get them in trouble," said Professor Kutz, whose school has been a particular focus of the Trump administration."You just don't know whether they are going to report you to someone, or are they recording you," said Dr. Smith, who added that she felt she had to "change the way I relate to my students."

The Washington Post's description of the bodycam video of his arrest last year, and the translation of Mr. Shah Alam's comments, is gutting. Remember, he was entirely blind in one eye and could only see three feet in the other, and he spoke virtually no English. He spent a year in jail for this.

Body-cam footage from the incident, reviewed by The Post, shows Shah Alam standing near the door of the shed holding two black poles. Officers shout at him and order him to drop the poles, reportedly curtain rods he’d fashioned into walking sticks. Shah Alam repeatedly says, “Sorry” while adjusting his grip on the poles and walking toward the officers. The officers continue to shout and warn that they will fire their Tasers. At one point, Shah Alam responds, “No,” then points the rods at the officers.

The officers both fire their Tasers and tackle him. Two officers report being bitten in the scuffle. After Shah Alam is restrained, the officers remark that they smell alcohol.

In the footage, Shah Alam can be heard speaking in Rohingya and Malay. He asks for God’s help and tries to explain to the uncomprehending officers that he lives nearby and was going to the store. He pleads with the officers not to throw away his phone.

See, I find begging for money very relatable. I can easily inhabit the mind of one who lets money override all other considerations; very much a there-but-for-the-grace-of-god cautionary tale. Summers had his own wealth, fame, connections... he just plain liked the guy. Felt he was a kindred spirit.
