If you want democracy, don’t try to do an end-run around democracy. Test your ideas in the electoral process. The judiciary is supposed to also serve as a check and balance to potential political corruption. And they do. To frame it as anti-democratic is bordering on rhetorical insanity.

Fourth, that a petition or referendum is a democratic right. No. It’s a statutory right, triggered by gov’t law (CIA) or gov’t action (unilateral referendum call) but there is no charter right to a referendum. This is Haig from Supreme Court (considering federal non binding referendum regime).
